There has been a steady increase in claims against design professionals on construction projects over the last decade. How does the Architect continue to protect its interests within an increasingly litigious environment? The answer lies in understanding key contract clauses that establish the roles and responsibilities of the participants in times of crisis. What you do when a problem arises, will determine the difference between change management versus claims management.

Litigation is the least desirable way to resolve most construction disputes. A large amount of time and money is expended educating courts and juries, who typically lack the experience to understand design and construction issues. In addition, the process is slow, inefficient and expensive. For an architect to succeed it needs to understand the contract tools that enable the parties to resolve disputes equitably.

Performance of activities during the course of the project has serious legal implications for all parties. The actions of one party often have a profound effect on the success of another. The ultimate quality and success of a project is determined by tact in providing instructions or interpretations, ability to adequately document progress and decisions, and sensitivity to expectations of the various parties.

Learning Objectives:

  1. Understand the difference between a dispute vs. a claim, the dispute escalation timeline, and the essential components required for a valid claim
  2. Identify an appropriate level of documentation required to sufficiently track progress/decisions, address risk, and to avoid claims
  3. Utilizing a case study example demonstrate techniques for proper risk management, claims avoidance, and minimizing the impacts of a claim
  4. Be able to utilize proper techniques for addressing and resolving disputes including analysis, defenses, and available resolution methods

About the Speaker:

Wayne Seiler, PSP

Wayne began his career with hands on construction experience as a field engineer and assistant superintendent with a general contracting firm. His experience also includes roles in estimating, and as a project engineer. The core area of his expertise lies in project scheduling, cost control and analysis, labor cost analysis, and schedule disruption analysis. Wayne is adept in schedule preparation issues including activity breakdown, work sequencing, resource leveling, cash flow, shop drawing submittals, and material procurement graphics.

At CPS, Wayne provides scheduling support and claims analysis on complex projects, including schools, universities, military installations, power plants, industrial manufacturing facilities, hospitals, and aquariums.
