Presentation:

This presentation will:
(i) discuss the roles and responsibilities of owners, architects and design-builders under AIA Contract Documents new Progressive Design-build documents;
(ii) explain the responsibilities of each project participant and explain how they are similar to those set out in other contract documents;
(iii) identify the key risks of traditional design-build process and explain how they are mitigated through a progressive design-build process; and
(iv) demonstrate how Progressive Design-build strengthens collaboration between project participants. Participants will appreciate why deeper collaboration leads to successful projects and helps architects protect the public’s health, safety, and welfare.

Learning Objectives:

  1. Gain an in-depth understanding of AIA’s view of Progressive Design-build and the workflow of a Progressive Design-build project.
  2. Explore how to use a teaming agreement and respond to requests for qualifications for a Progressive Design-build project.
  3. Identify key elements in the various agreements that define the contractual relationships in a Progressive Design-build project.
  4. Understand how the new Progressive Design-build documents support and protect the public welfare.

About the Speakers:

Donovan Olliff, AIA, Esq. is a Senior Vice President and General Counsel at HOK. With over thirty years of combined industry experience as both a registered architect and construction law attorney, Donovan has brought a wealth of knowledge and expertise to his role. He is a graduate of Texas Tech University College of Architecture (1993) and the University of Houston Law Center (2001). Donovan tenure at HOK has coincided with the rise of design-build as a dominant project delivery method and he has been at the forefront of navigating this shift. This experience has allowed Donovan to contribute to a broader impact on the industry as a whole. In addition to his responsibilities at HOK, Donovan has been an active member of the AIA Contract Documents Committee since 2016. In this capacity, he has contributed to the development and updating of key industry documents, including the 2024 Design-Build Documents. His work on the committee reflects his commitment to advancing the field and ensuring that industry standards evolve to meet contemporary needs.

Josh Flowers is a registered architect and licensed attorney and is General Counsel of HBG Design, a nationally-recognized leader in hospitality, entertainment and mixed-use design, headquartered in Memphis, Tennessee. Josh oversees legal, insurance and compliance matters for HBG and is a member of the firm’s Management Team. Josh received Bachelor of Architecture and Juris Doctor Degrees from the University of Tennessee where he served as editor of the Tennessee Law Review. He is a member of the American Bar Association Forum on the Construction Industry as well as the Memphis and Tennessee Bar Associations and the Association of Corporate Counsel. He is listed as a Rule 31 mediator in the State of Tennessee, and is a national speaker and writer on legal issues related to architectural practice and career development for design professionals.

Jennifer Taylor is a Sr. Strategic Delivery Manager at HDR, Jennifer specializes in large and complex alternative delivery projects. Her more than 25 years of experience includes four years at Oregon Health and Science University leading the Design and Construction Department. She is passionate about transforming project delivery to improve outcomes through building successful teams, collaboration, and innovation. Jennifer earned a Master’s in Architecture from Yale and is a licensed architect in Oregon. She is a member of the American Institute of Architects, a LEED Green Associate, an Associate DBIA and serves on the DBIA Oregon Chapter Steering Committee. She recently completed the UC Davis certificate program, Advanced Studies in Estimating and Integrated Cost Management.
